About our company

Michael Sauer is a court-appointed Special Civil Part Officer for the Superior Court of New Jersey. Officer Sauer covers two counties:

• Full-Time Special Civil Part Officer – Bergen County, New Jersey
• Part-Time Special Civil Part Officer – Passaic County, New Jersey (Landlord/Tenant matters only)

As an officer of the court, Officer Sauer’s responsibilities focus on the service and execution of court-issued process, including warrants for removal in landlord/tenant matters, in strict compliance with New Jersey court rules and Judiciary directives.


What is a Special Civil Part Officer?


A Special Civil Part Officer (SCPO) is a civil officer of the court appointed to serve and execute court-issued process in Special Civil Part matters, most commonly in landlord/tenant cases and certain post-judgment enforcement actions. SCPO’s are private contactors and not employees of the judiciary.

What a SCPO IS NOT:

·         A SPECIAL CIVIL PART OFFICER IS A CIVILIAN AND IS NOT A LAW ENFORCEMENT OFFICER

·       Although some SCPO’s are retired law enforcement, most are not and none have any law enforcement authority.  Although we are issued a badge from the court, a SCPO is a civilian and cannot enforce criminal laws.  Furthermore, SCPO’s are restricted from carrying a firearm during the commission of their court duties, even if they possess a personal concealed carry permit.

SCPOs are neutral court officers. We are not attorneys, do not represent any party, and cannot provide legal advice. All actions are performed strictly pursuant to court orders, statutes, court rules, and Judiciary directives.

WHAT WE DO:
• Serve summonses and complaints in landlord/tenant matters
• Serve and execute warrants for removal (evictions) when issued by the court
• Serve certain post-judgment enforcement process as authorized by the court
• Perform court-directed duties in compliance with New Jersey law

• Enforce criminal laws or act as law enforcement
• Represent landlords, tenants, creditors, or debtors
• Change, delay, or stop court orders
• Act without court authority

Your Questions, Answered

  • An SCPO is an officer of the court appointed to serve court process and execute certain court orders.

  • No. SCPOs are neutral court officers and cannot provide legal advice.

  • Typically, if money has been removed from your account it is because your account has been “levied”.  What that means is that you have an open civil judgment against you.  You have either not responded to requests for payment or you have defaulted on a payment arraignment.  When this happens, the attorney for the Plaintiff (not the SCPO) will petition the court for an order that allows the officer to seize funds from your bank account.  Although the money has been removed from your account, it is still at the bank.  It remains there until the Plaintiff’s attorney can go back to court and request a judge provides permission to release the funds to the officer.  Once the funds are disbursed to the officer, the funds are then disbursed to the plaintiff.

  • No. In New Jersey, warrants for removal are served and executed by only Special Civil Part Officers.

  • No. Only the court may modify or stay a court order.

  • Please contact our office during business hours.  If your call is not immediately answered, please leave a message and your call will be returned as soon as possible, typically within 24 hours.

  • The lockout fee is set by New Jersey Statue. The officer is entitled to $7.00 in mileage and $75.00 for additional services. The total of these two services is $82.00. The lockout fee is payable via cash or check on the day of the lockout. It is at the officer’s discretion to charge less than the $82, but cannot hcarge more without specific approval from the court.

  • Please contact our office. Our staff will guide you through what options you may have. Depending on the type of judgement, will determine what options, if any are avaialble.

  • You may send your payment via personal check, money order or certified bank check. Please make your check payable to Michael Sauer SCPO and mail it to P.O. Box 507, Hackensack, NJ 07602.

  • No, we do not accept credit cards, Zelle, Venmo, or any other electronic forms of payment. The only accepted forms of payment are personal checks, money orders or certified bank checks.

  • Please complete the worksheet that was attached to the court order. If you have questions, please feel free to contact our office and someone we be happy to assist you.
